This Privacy Policy (which we will refer to as “Privacy Statement“) applies to how Phase 3 Development, Inc. (o/a Phase 3 Development) (“our” or “us” or “we“) collects, uses and discloses Personal Information (as defined below). This Privacy Statement applies to visitors and users (individually “you” or “your“) of our website located at https://www.p3dev.com and all associated websites, applications, software, online services, email communications, advertisements, computer servers and networks linked to https://www.p3dev.com (collectively the “Platforms“).

BY USING THE PLATFORMS, YOU AGREE TO AND ACCEPT THIS PRIVACY STATEMENT. IF YOU DO NOT AGREE WITH THE TERMS SET OUT IN THIS PRIVACY STATEMENT, YOU MUST IMMEDIATELY CEASE USING AND ACCESSING THE PLATFORMS AND ANY CONTENT, SERVICES OR PRODUCTS CONTAINED IN OR AVAILABLE FROM THE PLATFORMS AND ANY CONTENT, SERVICES OR PRODUCTS CONTAINED IN OR AVAILABLE FROM THE PLATFORMS.

Phase 3 Development is committed to providing exemplary professional services and protecting your Personal Information. Personal Information means any information about an individual from which that person can be identified (“Personal Information“). We do not sell, trade, or otherwise transfer your Personal Information to outside third parties. Phase 3 Development is and shall remain committed to complying with all applicable laws, rules and regulations.

This Privacy Statement describes our privacy practices when we collect, process, use and disclose:

    1. Personal Information for the purposes of providing the benefits of the Platforms, which includes using your information to provide products and services; and/or
    2. Personal Information as necessary to manage, run and improve our business and improving the functionality of the Platforms.

  Section 1 - Collection Of Information

  1. We may collect Personal Information when you interact with the Platforms. Personal Information collected by Phase 3 Development may include:
  2.  Names and contact information of individuals who contact Phase 3 Development in a capacity other than a commercial capacity;
  3.  Information on the educational background and business or information technology related skills and experience of individuals and representatives or agents of entities with whom or which Phase 3 Development has or is pursuing a business relationship with;

Business contact information of an entity, which may include an individual”s name, position names or titles, business telephone numbers, business addresses, business emails, business faxes or other similar business information that is used by Phase 3 Development for the purpose of contacting that individual in that individual”s capacity as an employee or agent of and entity;
  5.    Financial and credit information; and
  6.  History of involvement with, or services provided to or by, Phase 3 Development.
  7.    Visitors or users of our website are not required to provide Personal Information and are not personally identified. IP addresses of computers are recorded as a standard operative function of our service and related software. Phase 3 Development may monitor traffic patterns, site usage and related site information to diagnose service problems and administer and modify our website.

Section 2 - Use of Information

  1.  We collect and process Personal Information from you only where:
  2. We have your express or implied consent to do so;
  3.    We need your Personal Information to perform a contract with you or provide a service to you;
  4. Provide you with the benefits of the Platforms and operate our business;
  5.   The processing is in our legitimate business interests in those jurisdictions where legitimate business interest is a legitimate basis for processing; or

  6.    We need to comply with legal requirements, including applicable laws and regulations.

  9.    Maintain and improve the functionality of the Platforms;
  10.  Personalize the services delivered under the Platforms;

  12. Run and manage our business;

  14. Authenticate your identity;
  15.  Protect the rights, property, safety or security of the Platforms, our customers, employees or others and prevent fraudulent or illegal activity;
  16. To exercise our rights in the course of judicial, administrative or arbitration proceedings;
  17. To enforce, remedy or apply our terms and conditions or other agreements; and/or
  18. For other purposes that are compatible with the disclosed purposes if and where this is permitted.

Section 3 - How We Share Your Information

  1. With your consent. Except for as outlined below, we only share your information with third parties when we have your direct or implied consent to do so.
  2.  To our service providers. We may provide your information to our service providers or third parties for the purposes of providing services or functions on behalf of Phase 3 DevelopmentPersonal Information will not be disclosed to such third party service providers except as described in this Policy Statement, with direct or implied consent of the individual or as required or permitted by law. Phase 3 Development will endeavour to ensure that its contracts with third party service providers limit the retention, use and disclosure of Personal Information by the third party service provider solely for the purpose of carrying out the contracted services and provide a level of protection for Personal Information that is comparable to that provided by Phase 3 Development.
  3. No sale of Personal Information to third parties. We do not and will not sell Personal Information to third parties. We will only share your Personal Information with third parties for the business purposes described in this Privacy Statement.
  4.  Sale of Business. We may transfer any information we have about you in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of our operations or as part of a corporate reorganization or stock sale or other change in corporate control.
  5. For legal reasons. We may share your Personal Information with third parties for legal reasons without your consent, and as permitted by law, including:
  6.  When we reasonably believe disclosure is required in order to comply with a subpoena, court order, or other applicable law, regulation or legal process;
  7. To protect the rights, property, or safety of us, the Platforms, our customers or others;

  12.  With regulatory agencies, including government tax agencies, as necessary to help detect and combat fraud and/or protect our customers, users and/or the Platforms, or in required institutional risk control programs.

Section 4 - Your Information Rights

  1. Unless you specifically ask us to delete your Personal Information, we retain your Personal Information as long as it is reasonably necessary to comply with our data retention requirements (including for financial reporting purposes) and provide you with services and the benefits of the Platforms. However, even if you request a deletion, we may be required to maintain your information for as long as necessary to:
  2. comply with our legal or regulatory compliance needs;

  3.  to exercise, establish or defend legal claims; and/or
  4.  to protect against fraudulent or abusive activity on our Platforms.
  5. This means we may keep different information for different periods. There may be occasions where we are unable to fully delete, anonymize, or de-identify your information due to technical, legal, regulatory compliance or other operational reasons. Where this is the case, we will take reasonable measures to securely isolate your Personal Information from any further processing until such time as we are able to delete, anonymize, or de-identify it.

Section 5 - Third Party Websites

  1.  Our Platforms may contain links to other websites.” We provide these links solely as a convenience to you and we do not necessarily support or endorse the information. Ifa third party payment processing provider is utilized on the Platforms, the third party payment provider may by necessity collect your payment information to processes payments made on or through the Platforms. The information we obtain about your method of payment is limited to the extent possible.
  2.  We are not responsible for the content and privacy policies of other websites or payment processors. Information that you disclose to a third party during the course of accessing our Platforms will be subject to the privacy policy of that third party. We encourage you to examine each website”s privacy policy and disclaimers and make your own decisions regarding the accuracy, reliability and correctness of material and information found there.

Section 6 - Security of your Personal Information

  1. The security of your Personal Information is important to us. We will use reasonable security measures to protect your Personal Information against unauthorized access, disclosure, copying, use, or modification. We use physical, technical and organizational safeguards designed to protect your information. However, despite these controls, we cannot completely ensure or warrant the security of your information.
  2.  When handling Personal Information, Phase 3 Development adheres to the following principles that Personal Information shall be:

  4.  collected only for specified, explicit and legitimate purposes;
  5. adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed;
  6.  accurate and where necessary kept up to date;
  7. not kept in a form which permits identification of data subjects for longer than is necessary for the purposes for which the Personal Information is processed;
  8. processed in a manner that ensures its security using appropriate technical and organizational measures to protect against unauthorized or unlawful processing and against accidental loss, destruction or damage;
  9. not transferred to another country without appropriate safeguards being in place; and
  10. made available to data subjects and allow data subjects to exercise certain rights in relation to their Personal Information.
  11. Your Personal Information may be used or stored by us or our service providers outside of Canada. We require that our service provider safeguard your Personal Information. However, if your Personal Information is used or stored outside of Canada, it will also be subject to the laws of the country in which it is stored.

Section 7- International Users

  1. Our Platforms may be accessed by an international audience. By using our Platforms and providing us with data, you acknowledge and agree that your Personal Information may be processed for the purposes identified in this Privacy Statement. In addition, such data may be stored on servers located outside your resident jurisdiction and in jurisdictions which may have less stringent privacy practices than your own. By providing us with your data, you consent to the transfer of such data. We will take all steps reasonably necessary to ensure that your Personal Information is treated securely and in accordance with this Privacy Statement and Canadian law.

Section 8 - Changes to our Privacy Statement

  1. From time to time we may change, modify, add or remove portions of this Privacy Statement. We reserve the right to make such changes at any time. It is your responsibility to check this Privacy Statement periodically for changes. Your continued use of the Platforms following the posting of changes will mean that you accept and agree to the changes.
  2. If we make material changes to the way we process your Personal Information, we will notify you by posting a notice in our Platforms or on a community post, by sending you a notification, or by other means consistent with applicable law.

Section 9 - Access and Correction

  1. Individuals are permitted, by law, to submit written requests to obtain the following:
  2. Their Personal Information under the custody or control of Phase 3 Development;
  3. Information about the purposes for which their Personal Information under the custody or control of Phase 3 Development has been and is being used; and
  4. The names of persons to whom and the circumstances in which their Personal Information has been and is being disclosed by Phase 3 Development.
  5. Each such request will be responded to as accurately and completely as reasonably possible. An individual”s ability to access their Personal Information under the control of Phase 3 Development is not absolute. Phase 3 Development shall not disclose Personal Information where doing so would likely reveal Personal Information about a third party, or where Phase 3 Development chooses not to disclose the Personal Information, including where disclosure would reveal confidential commercial information.

Section 10 - Privacy Complaints and Concerns

  1.   If you believe that Phase 3 Development has failed to comply with this Policy Statement of applicable privacy legislation you have the right to make a written complaint about the matter to Phase 3 Development. Complaints shall be addressed to:

  3.   Phase 3 Development may:
  4. cause an internal investigation into a complaint to be conducted;
  5. respond to the complainant within a reasonable time;
  6.  inform the complainant of the outcome of the investigation regarding the reviewable complaint; and
  7.  if a reviewable complaint is found by Phase 3 Development to be justified, Phase 3 Development will endeavour to take appropriate steps to resolve the complaint including, if necessary, amending this Policy Statement or our other privacy policies and procedures.
  8. A complaint must be in writing and provide Phase 3 Development with full details of the circumstances of the complaint, the names of parties known to be involved, copies of relevant available documentation and reasons why the complainant believes there has been a breach of this Policy Statement or applicable privacy legislation.
  9. An individual has the right to make a complaint to the Privacy Commissioner or ask the Privacy Commissioner to review a decision made by Phase 3 Development. Individuals are encouraged to first use Phase 3 Development”s internal complaint procedure outlined in sections 10.1 ” 10.3 of this Policy.
